BRITNEY SPEARS is being sued by a photographer whose foot she ran over in 2007.

The incident occurred in Beverly Hills and was captured on video by the site TMZ.

Britney was pulling out of a car parking lot when she ran over Rick Mendoza’s foot. Mendoza was seen walking away from the scene however, a witness claims that they heard his food crack.

In the lawsuit, Mendoza said Britney’s people – who are also defendants: “should have known…Britney was not in the mental, emotional and/or physical condition to operate the subject motor vehicle in a safe and reasonable manner.”
